Terms and Conditions

These Terms and Conditions govern your use of the websites accessible at alwaysyourfriend.org and alwaysyourfriend.gr (the “Website”) and any orders you place through the Website. Please read these Terms and Conditions carefully, as they affect your legal rights and obligations. By using the Website, you acknowledge that you have read, understood, and accepted these Terms and Conditions. Prior to placing an order, you must confirm your acceptance by clicking the “I Accept” button. If you do not agree with these Terms and Conditions, please do not register for or use the Website. Note that to purchase goods or access certain sections of the Website, you must register as an authorized user.

1. Ownership and Intellectual Property

1.1 The Website is owned and operated by ALWAYS YOUR FRIEND EE, trading as “Always Your Friend”, a company registered in Greece. Our VAT number is 802152160, and our registered office is located at K FOUMI 288, 73132, Chania, Crete, Greece.

1.2 All copyright and other intellectual property rights in the Website and all its content belong solely to us. As a visitor, you may download a single copy of any material on the Website solely for your personal, non-commercial use, provided that all copyright and proprietary notices remain intact.

1.3 Except as expressly permitted in clause 1.2, you may not copy, reproduce, distribute, or otherwise use any content from the Website for commercial or business purposes without our prior written consent. You may not display the Website’s content within a frame or embed it in a manner that surrounds it with material not originating from us unless you have our express written permission.

1.4 No license or right to use any of our trademarks—whether registered or unregistered—is granted to you by these Terms and Conditions.

2. Your Account

2.1 If you use the Website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorized access. You agree to be responsible for all activities that occur under your account or password. Please ensure that your password remains secure and notify us immediately if you suspect any unauthorized use.

2.2 You must ensure that the information you provide during registration or at any time is accurate and complete.

2.3 You are required to promptly update any changes to your personal information.

2.4 The Website sells products only to individuals aged 18 or over. Users under 18 may use the Website only with the involvement and supervision of a parent or guardian, who must accept these Terms and Conditions and place orders on their behalf. By using the Website, you confirm that you are at least 18 years old.

3. Website Information and Availability

3.1 Although we strive to ensure that the information on the Website is accurate and complete, you are advised to verify any information before relying on it. Due to the nature of the Internet, errors, interruptions, or delays may occur. Subject to clause 13 below, the Website is provided “AS IS” and all warranties are excluded to the fullest extent permitted by law. We accept no liability for any inaccuracies, omissions, or interruptions.

3.2 Should you experience any technical fault with the Website, please report it to our Customer Services via email so that we can address the issue promptly.

3.3 Access to the Website may occasionally be restricted for repairs, maintenance, or the introduction of new features or services. We will make every reasonable effort to restore access as quickly as possible.

3.4 Please note the following:

  • 3.4.1 Always refer to the product packaging upon receipt of your order for the most accurate and up-to-date information regarding product ingredients.
  • 3.4.2 Suitable Breeds: When shopping online, it can be difficult to assess the actual size or suitability of a product. Where possible, we provide a guide listing potentially suitable dog breeds for many of our products. Given the vast number of dog breeds worldwide, this guide is only for reference and not definitive. Each pet is unique; therefore, while a product may generally suit a particular breed, it might not be appropriate for every individual pet. Please ensure that the products you purchase meet your pet’s specific requirements.

4. Promotions, Vouchers, and Competitions

4.1 From time to time, we or selected third parties may offer promotions, vouchers, competitions, or other offers on the Website. Each offer is subject to its own express terms and is available only while stocks last. Your statutory rights are unaffected by these offers.

4.2 Any coupons, discounts, or promotional codes offered on the Website are valid solely for purchases made through the Website unless otherwise stated.

5. Limitations on Use

5.1 You agree not to use the Website for:

  • 5.1.1 Transmitting any material that is illegal, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable.
  • 5.1.2 Transmitting material that encourages conduct constituting a criminal offense, civil liability, or otherwise breaches any applicable laws, regulations, or codes of practice.
  • 5.1.3 Gaining unauthorized access to other computer systems.
  • 5.1.4 Interfering with any other person’s use or enjoyment of the Website.
  • 5.1.5 Violating any laws related to the use of public telecommunications networks.
  • 5.1.6 Disrupting networks or websites connected to the Website.
  • 5.1.7 Creating, transmitting, or storing electronic copies of material protected by copyright without the owner’s permission.

5.2 We reserve the right to refuse publication of any material on the Website or to remove any material already published.

5.3 You agree to fully indemnify us against any losses, liabilities, costs, or expenses (including damages, settlements, or fines) incurred as a result of any claims arising from your use of the Website, including any claims that your use is defamatory, abusive, or infringes upon third-party intellectual property rights.

6. Right to Suspend or Cancel Your Registration

6.1 We may suspend or cancel your registration or restrict your access to the Website at our reasonable discretion if you breach any of your obligations under these Terms and Conditions.

6.2 You may cancel this agreement at any time by providing us with written notice. Upon cancellation, you must immediately cease using the Website.

6.3 Suspension or cancellation of your registration shall not affect any rights or obligations that have accrued prior to such suspension or cancellation.

6.4 Clauses 1, 5, and 10 of these Terms and Conditions shall survive cancellation.

7. Ordering Goods

7.1 All orders placed through the Website are subject to our acceptance.

7.2 When you place an order, you will receive an acknowledgement email (“Acknowledgement Email”). Please verify the accuracy of this email and notify us immediately if any errors are found. The Acknowledgement Email does not constitute acceptance of your order. Your order is an offer to purchase goods from us. We will confirm acceptance by sending you a Dispatch Confirmation email (“Dispatch Confirmation”). The contract (“Contract”) is formed only upon receipt of the Dispatch Confirmation. Title to the goods passes to you on delivery, provided that full payment has been received. The Contract applies solely to those products whose dispatch has been confirmed. Any additional products in your order will require a separate Dispatch Confirmation.

7.3 If you use a promotional code to obtain a discount, acceptance of your order is subject to our verification that the code was issued for your personal use and that you meet all promotional conditions. If you do not qualify, the order price will be adjusted accordingly. Refunds for goods purchased under a promotional offer will be governed by the promotional terms. Your statutory rights remain unaffected.

8. Pricing, Order Processing, and Payment

8.1 The price of any goods will be as quoted on the Website, except in cases of obvious error. In the event of pricing inaccuracies, we reserve the right not to fulfill or to cancel any orders placed in reliance on such errors, subject to clause 8.4.

8.2 Prices may change at any time; however, changes will not affect orders for which a Dispatch Confirmation has already been sent.

8.3 Payment for all goods (via credit or debit card) will be processed at the time of order, after verifying your card details and stock availability. If we do not accept your order, any payment made will be refunded.

8.4 While we aim to maintain an up-to-date and error-free Website, product descriptions or pricing errors may occur. If such an error is discovered after your order is placed, we will contact you with the correct details before accepting your order. You may then choose to cancel or confirm the order based on the updated information. If we are unable to contact you, your order will be deemed cancelled.

8.5 All prices displayed on the Website are inclusive of VAT. Delivery charges are clearly indicated throughout the Website.

9. Availability and Delivery

Your order will be fulfilled by the delivery date specified in the Dispatch Confirmation, or, if no date is specified, within 30 days from the date of the Dispatch Confirmation—except in cases of exceptional circumstances such as a Force Majeure event (see clause 15).

10. Risk and Title

10.1 Risk in the goods passes to you upon delivery.

10.2 Title to the goods transfers to you only once full payment, including any delivery charges, has been received.

11. Our Liability

11.1 We warrant that any goods purchased from us via the Website are of satisfactory quality and reasonably fit for the purposes for which such goods are commonly supplied.

11.2 We shall not be liable to you or any third party, whether in contract, tort (including negligence), or otherwise, for any incidental, special, indirect, or consequential loss or damage, including loss of profit, sales, goodwill, or business, or for any pure economic loss arising out of or in connection with our performance—or non-performance—of our obligations under these Terms, even if such loss was foreseeable.

11.3 If you are contracting as a business, our liability for any claim is limited to the purchase price of the goods.

11.4 If you are contracting as a consumer, our liability for any claim is limited to three times the purchase price of the goods.

11.5 Nothing in these Terms excludes or limits our liability for:

  • (a) death or personal injury caused by our negligence;
  • (b) fraud or fraudulent misrepresentation; or
  • (c) any matter for which it would be unlawful to exclude or limit our liability.

12. Limitations of Liability

12.1 Nothing in these Terms shall exclude or limit the liability of Always Your Friend for losses that cannot be lawfully excluded or limited under applicable law.

12.2 Always Your Friend shall not be liable for any loss, claim, or damage—including any indirect, special, incidental, or consequential damages—arising from (a) your use or inability to use the Website or its content, or (b) unauthorized access to or alteration of your data, even if we have been advised of the possibility of such damages, except where such loss results from our gross negligence or willful misconduct.

13. Written Communications

13.1 Certain communications from us must be in writing under applicable law. By using the Website, you consent to receiving communications electronically (via email or posted notices on the Website). For contractual purposes, you agree that all contracts, notices, and communications provided electronically meet any legal requirement for written communication. This provision does not affect your statutory rights.

14. Notices

14.1 All notices to us must be sent to:
ALWAYS YOUR FRIEND EE
K FOUMI 288, 73132, Chania, Crete, Greece

14.2 We may also notify you at the email or postal address you provide when placing an order, or by other means as specified. A notice is deemed received immediately upon posting on the Website, 24 hours after being sent via email, or three days after being mailed. Proof of service of any notice shall be deemed sufficient if it shows that the notice was properly addressed and dispatched.

15. Events Beyond Our Control (Force Majeure)

15.1 We shall not be liable for any failure or delay in performing our obligations under any contract arising from events beyond our reasonable control (“Force Majeure Event”).

15.2 A Force Majeure Event includes, without limitation:

  • Strikes, lockouts, or other industrial actions;
  • Civil commotion, riots, invasions, terrorist attacks or threats, war (declared or not), or preparations for war;
  • Fire, explosion, adverse weather conditions (including storms, floods, earthquakes, or landslides), epidemics, or other natural disasters;
  • The inability to use public or private transport or telecommunications networks;
  • Computer hacking, viruses, or similar disruptions; and
  • Acts, decrees, legislation, regulations, or restrictions imposed by any government.

15.3 Our performance under any contract is deemed suspended for the duration of the Force Majeure Event, and we shall be granted an extension of time to perform our obligations. We will endeavor to resolve the Force Majeure Event or find an alternative solution that allows us to fulfill our contractual obligations.

16. Waiver

16.1 If we fail to enforce any of your obligations under these Terms or to exercise any rights or remedies available to us, such failure shall not constitute a waiver of those rights or remedies, nor prevent us from enforcing them at a later date.

16.2 A waiver by us of any breach shall not constitute a waiver of any subsequent breach.

16.3 No waiver shall be effective unless explicitly stated in writing and communicated to you in accordance with clause 14.

17. General Provisions

17.1 These Terms and Conditions and any contracts formed between you and us are governed by Greek law. Any disputes arising from your use of the Website or these Terms shall be subject to the exclusive jurisdiction of the courts of Greece. If you access the Website from outside Greece, you do so at your own risk and are responsible for compliance with local laws.

17.2 A person who is not a party to these Terms or any contract between us shall have no right to enforce any provision herein.

17.3 If any provision of these Terms is deemed invalid, unlawful, or unenforceable by a court, that provision shall be severed to the extent necessary, and the remaining provisions shall continue in full force and effect.

17.4 We may assign, transfer, or subcontract any of our rights or obligations under these Terms at any time without prior notice.

17.5 You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent.

17.6 We reserve the right to revise and amend these Terms from time to time. Any changes will be posted on the Website and will apply to orders placed after such changes become effective. If you do not agree with the new Terms, you should cease using the Website. Continued use constitutes acceptance of the revised Terms.

17.7 These Terms and Conditions constitute the entire agreement between you and us regarding your use of the Website and will remain in effect for the duration of our business relationship.
